About Section 8 Company Registration

A Section 8 Company is a non-profit organisation registered under the Companies Act, 2013 for promoting charitable objects such as education, art, science, sports, social welfare, environmental protection or charity. It is the most credible NGO structure in India because it is regulated by the MCA with the same governance discipline as a company, which builds trust with donors, CSR funders and government bodies. Any profits or income must be applied solely towards the organisation's objectives and cannot be distributed to members. A Section 8 Company can later obtain 12A and 80G registrations to unlock income-tax exemptions and donor deductions.

Documents required

The process — step by step

  1. Obtain DSC and DIN for directors
  2. Reserve the company name
  3. Apply for a Section 8 licence in Form INC-12
  4. File SPICe+ incorporation with MOA & AOA
  5. Receive licence and Certificate of Incorporation
